1. Agreement to Terms

Welcome to Island Pitch LLC ("Island Pitch," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website at islandpitch.com, including our interactive Learn AI Experience, blog, and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Island Pitch provides the following Services:

  • Website — Our main website at islandpitch.com, which includes informational pages about our company and services, a blog with articles and commentary, and contact forms for reaching our team.
  • Learn AI Experience — An interactive AI literacy training experience located at islandpitch.com/learn-ai. This is a guided, game-style curriculum spanning five levels that teaches users about artificial intelligence concepts. Users interact with AI-powered agents (JdAI Guide and IP Bot) through voice or text. Voice mode requires access to your device's microphone. Game progress is saved locally in your browser using localStorage.
  • Blog — A content hub where we publish articles and where users may leave comments.

3. Eligibility

You must be at least 13 years of age to use the Learn AI Experience. This age requirement is enforced through an age gate before accessing the AI features.

If you are between the ages of 13 and 17, we encourage you to review these Terms with a parent or guardian. Parents and guardians should be aware that the Learn AI Experience involves real-time interactions with AI agents, including optional voice-based communication.

By using the Services, you represent that you meet these eligibility requirements.

4. User Accounts

Our Services do not require you to create an account or log in. The Learn AI Experience saves your game progress locally in your browser's storage. This data stays on your device and can be cleared at any time by you.

5. Acceptable Use and Prohibited Activities

You agree to use our Services only for lawful purposes and in accordance with these Terms. When using our Services, you agree not to:

  • Abuse, harass, threaten, or use offensive language toward our AI agents or other users
  • Attempt to extract, reverse engineer, or reveal system prompts, internal instructions, or proprietary configurations of our AI agents
  • Use the AI agents to generate illegal, harmful, defamatory, or misleading content
  • Attempt to circumvent the age gate or other safety measures
  • Reverse engineer, decompile, or disassemble any part of our Services
  • Use automated tools, bots, or scrapers to access the Services in a manner that exceeds reasonable use
  • Interfere with or disrupt the integrity or performance of the Services
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Share sensitive personal information — such as Social Security numbers, financial account details, or medical information — during conversations with our AI agents
  • Use the Services for any purpose that violates applicable local, state, national, or international law

We reserve the right to terminate or restrict your access to the Services if we reasonably believe you are violating these Terms.

6. Intellectual Property

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, images, audio clips, animations, curriculum materials, and software — are owned by Island Pitch LLC, its licensors, or other providers and are protected by United States and international copyright, trademark, and other intellectual property laws.

The following are the property of Island Pitch LLC:

  • The characters IP Bot and Masked Crewsader, including all visual depictions and animations
  • The Learn AI curriculum and all associated educational content
  • The Island Pitch name, logo, and branding
  • "Do Cool Things the Right Way" is a registered trademark of Island Pitch LLC

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without our prior written consent.

7. AI Experience — Specific Terms

The following terms apply specifically to the Learn AI Experience:

7.1 AI-Powered Interactions

The JdAI Guide and IP Bot are artificial intelligence agents, not human advisors, counselors, or professionals. Their responses are generated by AI technology and are designed for educational purposes only.

7.2 Accuracy and Limitations

AI-generated content may occasionally contain inaccurate, incomplete, or outdated information. The Learn AI Experience is not a substitute for professional advice of any kind — including legal, financial, medical, or career advice. You should independently verify any information before relying on it.

7.3 Voice Recording and Storage

When you use voice mode, your audio is recorded and processed by our AI service provider to generate responses. Voice recordings are stored as part of conversation data. If you would like your voice recordings deleted, you may submit a request to privacy@islandpitch.com. We will process deletion requests in a timely manner.

7.4 Service Provider

Voice and text interactions are processed by ElevenLabs, our third-party AI service provider. By using the Learn AI Experience, you acknowledge that your conversation data — including voice audio and text input — is transmitted to and processed by ElevenLabs in accordance with their terms of service and privacy policy.

7.5 Data Use for Improvement

We may use anonymized, aggregated conversation data to analyze usage patterns and improve the Learn AI Experience. This data is stripped of personally identifiable information and is used solely for product improvement purposes.

7.6 Availability

The AI agents may occasionally be unavailable due to scheduled maintenance, technical issues, or service provider outages. We do not guarantee uninterrupted access to the Learn AI Experience and are not liable for any disruptions.

7.7 Sensitive Information

Do not share sensitive personal information during your conversations with the AI agents. This includes but is not limited to Social Security numbers, bank account or credit card numbers, passwords, and medical or health information. We are not responsible for any consequences arising from your voluntary disclosure of such information.

8. User Content

Certain features of the Services allow you to submit content, including blog comments and conversation input ("User Content"). You retain ownership of any User Content you submit, but by submitting it, you grant Island Pitch LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute your User Content in connection with operating and improving the Services.

You represent and warrant that your User Content does not violate any third party's rights and complies with these Terms and all applicable laws.

We reserve the right to remove any User Content that we believe violates these Terms or is otherwise objectionable, at our sole discretion.

9. Third-Party Services

Our Services rely on and integrate with third-party providers, including:

  • ElevenLabs — AI voice and text processing for the Learn AI Experience
  • HubSpot — Website hosting, content management, and forms
  • Google Fonts — Web typography

Your use of these third-party services may be subject to their own terms and privacy policies. We are not responsible for the practices or content of any third-party services. We encourage you to review their terms independently.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ISLAND PITCH LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Services will be uninterrupted, error-free, or secure, that defects will be corrected, or that the AI agents will produce accurate, complete, or reliable results.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ISLAND PITCH LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Island Pitch LLC, its officers, directors, members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services
  • Your violation of these Terms
  • Your User Content
  • Your violation of any rights of a third party
  • Your violation of any applicable law or regulation

13. Governing Law

These Terms and any disputes arising from or related to them or the Services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any legal proceedings that are not subject to the arbitration provision below shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal dispute proceedings, you agree to first contact us at legal@islandpitch.com and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved quickly and amicably through direct communication.

14.2 Binding Arbitration

If we are unable to resolve a dispute informally, you and Island Pitch LLC agree that any remaining dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by a mutually agreed-upon arbitration provider, in accordance with its applicable rules. The arbitration shall take place in Los Angeles County, California, or at another mutually agreed-upon location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14.3 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court if the claim falls within the court's jurisdictional limits.

14.4 No Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. If we make material changes, we will make reasonable efforts to provide notice — such as a prominent announcement on our website.

Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

18. Effective Date

These Terms of Use are effective as of February 25, 2026.
